ACCEPTANCE

• This document “End User License Agreement for Beta Testing” or (“BETA EULA”) is a legal agreement between You (“You”, “End User” or “User”) and Lumion Technologies Limited , a company with registered and business offices at #1650, Arlington Business Park Theale, Reading Berkshire, RG7 4SA, UNITED KINGDOM (the “Company”, “We”, “Us”) and governs Your use of our game – “Lokko” or the “Game”, whether or not You are a registered End User of the Company or Lokko.

PLEASE NOTE THAT BY ACCESSING AND/OR PLAYING THE GAME, YOU AGREE TO ABIDE BY AND BE BOUND BY THIS BETA EULA. YOUR ACCESSING AND PLAYING OF THE GAME CONSTITUTES YOUR ACCEPTANCE OF THIS BETA EULA. IF YOU DO NOT AGREE TO THE TERMS HEREIN, PLEASE DO NOT ACCESS AND PLAY THE GAME.

• You hereby understand and acknowledge that this pre-release version of the Game and any software programs or files that are provided to You (via online transmission or otherwise) including 'patch,' or 'update', as well as any online or electronic documentation, and any and all copies and derivative works of such Game and any accessory software programs therein are the copyrighted work of the Company. All use of the Game is governed by the terms of this BETA EULA. You hereby acknowledge that Your access and use of the Game is  solely for purposes of testing the Game in accordance with the terms of this BETA EULA and any use, reproduction or redistribution of the Game including not expressly authorized by the terms of this BETA EULA is expressly prohibited.

• You have been invited to participate in the playtest testing environment for the sole purpose of evaluating the Game and identifying bugs (the "Open Beta"). Nothing in this BETA EULA shall be interpreted as granting you any rights or privileges of any kind with respect to the Open Beta. The Game is provided on an "as is" and "as available" basis and We make no warranty to you of any kind, express or implied. By accessing and/or playing the Game, You agree to be bound by the following terms and conditions:

 

GRANT OF LICENSE

• The Company hereby grants You a limited, personal, non-exclusive, non-transferable, non-assignable and fully revocable license to use the Game, and any content therefrom for your individual, non-commercial, entertainment purposes only, subject to Your compliance with this BETA EULA. The license includes the right to install and use one (1) copy of the Game for Your personal use on Your computing device or hardware which You own or which is under Your personal control. The grant of license shall be automatically revoked in the event that any of the foregoing conditions are no longer met by You.

• You may not sub-license, or charge others to use or access the Game. You may not translate, reverse-engineer, reverse-compile or decompile, disassemble or make derivative works from the Game. You may not modify the Game or use it in any way not expressly authorized in writing by Us. You understand that the Game’s performance may vary depending on the device  and other equipment that You use to access and play the Game. You understand that certain updates and modifications may be required to be installed  in order to access and play the Game. You agree that the Company may stop providing support for previous versions of the Game upon availability of an updated version.

 

OPEN BETA OPERATION

• When you use the Game, your IP address (the Internet protocol address from which you access any of the above) may be stored in our records. When the Game, or any element or module thereof, is updated or “patched,” our patch routine may check your device to see that you have the most recent version of game-specific files; when you communicate within the Game or any communication feature in the Game (e.g. live chat, instant message services and the like), even “privately” to another person, you do so with the understanding that those communications go through our servers, can be monitored by us. Accordingly, you have no expectation of privacy in any of those communications and, accordingly, you expressly consent to monitoring communications that you send and receive.

 

• When playing the Game, You may accumulate points, equipment, or other value or status indicators. This data may be reset at any time during the testing process, and it may be reset when the particular Game build, patch or update completes the testing phase.

• By opting in to the Open Beta, You agree that: (i) participation in the Open Beta is at Your own risk and that You know that the Game, and/or Open Beta materials may include known or unknown bugs, (ii) any value or status indicators that You achieve through game play may be erased at any time, (iii) the Company has no obligation to make the Game available for play without charge for any period of time, nor to make them available at all, and (iv) this BETA EULA will apply to Your use of the Game during the playtest testing phase.

• As part of the Open Beta, You may become privy to certain Confidential Information regarding the Game. This Confidential Information shall be held in strict confidence and shall not be disseminated or disclosed to any third party without the express written consent of the Company. Disclosure of this Confidential Information without the express written consent of the Company shall result in immediate termination of this BETA EULA ending Your participation in the Open Beta. The Company shall be entitled to pursue all remedies available under the BETA EULA in this event. The Companys may at its option ask you to enter into a confidentiality agreement BEFORE you are allowed to use the Game and/or BEFORE the Game is provided or made accessible to you. Where the word Confidential Information shall be used to mean all nonpublic information disclosed by the Company, whether in oral, written, electronic, visual, or other form, that is designated as confidential or that, given the nature of the information or circumstances surrounding its disclosure, reasonably should be understood to be confidential. Confidential Information includes, without limitation unreleased or released game concepts, mechanics, rules, strategies, artwork, designs, storyboards, scripts, character concepts, music, sound files, voice recordings, prototypes, source code, object code, algorithms, engines, tools, builds, testing methodologies, and other technical materials;

• The Game may contain functions for collecting and tracking information related to the testers' use of the Game. You acknowledge that the Company does and may collect data derived from Your using/ playing the Game and it reserves the right to compile, save, use and analyze such information. The collection and storage or the above data and game play is solely for the purposes of facilitating the existing functionality of the Game, assisting the Company in assessing improvements to it and other games based on general playing patterns and for digital management purposes.

• As part of the Open Beta, You may be asked to provide suggestions, comments, requests for noticeable bugs and other feedback with respect to the Game ("Feedback"). The Company may provide you with methods of communication that may include without limitation forums, email, ticket or in-game system, and/or surveys to submit your feedback and/or report any errors, bugs or problems with the Game. You hereby grant the Company the worldwide, exclusive, transferable, perpetual, irrevocable, royalty-free, fully paid-up right to: (i) make, have made, use, copy, modify, and create derivative works of the Feedback as part of any Company product, technology, service, specification or documentation; (ii) publicly perform or display, import, broadcast, transmit, distribute, license, offer to sell and sell, rent, lease or lend copies of the Feedback identifying You or Your User name as the contributor of the Feedback (and derivative works thereof and improvements thereon); and (iii) sublicense to third parties the foregoing rights, including the right to sublicense to further third parties.

• YOU ACKNOWLEDGE AND AGREE THAT THE DEVELOPMENT OF THE GAME IS NOT COMPLETE AND THAT THE GAME IS PROVIDED AS IS, WITHOUT WARRANTIES OF ANY KIND. YOU ACKNOWLEDGE AND AGREE THAT THE GAME (I) CANNOT BE EXPECTED TO RUN WITHOUT ERRORS, BUGS OR INTERRUPTION, (II) MAY NOT FUNCTION ON YOUR DEVICE AND/OR SYSTEM AND (III) MAY FAIL AND/OR CAUSE LOSS OF DATA. THE COMPANY WILL NOT BE LIABLE TO YOU FOR ANY DIRECT OR INDIRECT DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES FOR LOSS OF DATA, ARISING FROM YOUR USE OR INABILITY TO USE THE GAME.

• You acknowledge that, by participating in the testing of the Game, you may be exposed to offensive, vulgar content or unacceptable conduct from other testers. If you encounter this kind of behavior, please report this activity to the Company through the methods of communication provided.

​

• You acknowledge that the testing of the Game may require an Internet connection and the use of hardware and software, and that, unless provided otherwise by the Company, the obtention and maintenance of such hardware and software is your sole responsibility, as well as paying any Internet access and/or bandwidth fees necessary to test the Game. You will also be responsible for the payment of all of your expenses incurred in the testing of the Game, including travel to the Company's office, when necessary, except as prior approved by the Company in writing. All consideration that you may receive from the Company for the testing of the Game may be taxable and you are solely responsible to declare the entire amount as revenue in your tax return if required by applicable law. The Company may withhold taxes from any consideration owed by you in order to remit such withholdings to the requesting governmental authority.

YOUR RESPONSIBILITIES AS A TESTER

• Subject to the grant of license to You herein, You may not, in whole or in part, copy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, or create derivative works based on the Software, or remove any proprietary notices on or in the Software. Failure to comply with the restrictions and limitations contained in this Section D shall result in the immediate, automatic termination of the license granted hereunder and We may subject You to civil and/or criminal penalties

• You agree that You shall not, under any circumstances:

​

• sell, grant a security interest in or transfer reproductions of the Game to other parties in any way not expressly authorized herein, nor shall You rent, lease or license the Game;

• transfer, sell or disclose to any person or entity other than the Company any CD-key, serial number, activation code, or other unique identifier or means of authentication provided to You by the Company;

• exploit the Game, or any of its parts, including but not limited to the Game, for any commercial purpose including, but not limited to, use at a ‘cyber-café’, computer gaming center or any other location-based site; 

• host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by the Company in any way, including without limitation through protocol emulation, tunneling, packet sniffing, modifying or adding components to the Game, use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to unauthorized network play over the Internet, network play utilizing commercial or non-commercial gaming networks or as part of content aggregation networks; or

• create or maintain, under any circumstance, any unauthorized connections to the Game. All connections to the Game may only be made through methods and means expressly approved by the Company and/or its third-party licensors with respect to the Game (if any). Under no circumstances may You connect or create tools that allow You or others to connect to the Game's interface or interfaces other than those expressly provided for public use.

 

• You agree that any unauthorized use or disclosure of Confidential Information shall cause the Company irreparable harm for which its remedies at law would be inadequate. Accordingly, You agree that the Company, in addition to any other available remedies, shall have the right to an immediate injunction and other equitable relief enjoining any breach or threatened breach of this Agreement, You shall notify the Company in writing immediately if You have reason to believe that any person who has had access to the Confidential Information has violated or intends to violate the terms of this Agreement or otherwise disclose any of the Confidential Information in violation of the terms hereof. Any and all remedies herein expressly conferred upon the Company will be deemed cumulative with and not exclusive of any other remedy conferred hereby, or by law or equity, and the exercise by the Company of any one remedy will not preclude the exercise of any other remedy.

TERM OF THE OPEN BETA

• The Game is an 'online' game that allows You to play the Game over the internet. The Company may, at any time and in its sole discretion, terminate this BETA EULA and/or discontinue the operation or provision of the Game, or any online features or components, with or without notice. In such case, this BETA EULA along with your access to the Game will terminate immediately.

INTELLECTUAL PROPERTY AND USER GENERATED CONTENT

• ​​All title, ownership rights and intellectual property rights in and to the Game (including, without limitation, all text, graphics, music or sounds, all messages or items of information, fictional characters, names, themes, objects, scenery, costumes, effects, dialogues, slogans, places, characters, diagrams, concepts, choreographies, videos, audio-visual effects, domain names and any other elements which are part of the Game, individually or in combination) are owned by the Company or its licensors and are protected by copyright, trade dress, patent, and trademark laws, international conventions, and other laws protecting intellectual property and related proprietary rights in the United Kingdom and across the world. You may not copy or download any content from the Game unless our terms expressly authorize you to do so. You agree not to remove, obscure, or alter copyright, patent, trademark, or other proprietary rights notices affixed to any content. You may not sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Game. The Company reserves all rights in the Company owned and licensed Game that are not expressly granted to you in this BETA EULA. You acknowledge that the Company and/or third-party content providers remain the owners of all materials posted in the Game, and that you do not acquire any of those ownership rights by downloading copyrighted materials.

​

• You grant the Company a worldwide, royalty-free, irrevocable, perpetual, non-exclusive, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display all or any portion of your User Generated Content, and to incorporate your User-Generated Content in other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes, without any payment to you. Where "User-Generated Content" means text, images, audio, video, experiences, or other content that you create within the Game and are able to share with the public or other users of the Game.

​

• The Company is not responsible or liable for any User-Generated Content. We are not responsible for any loss or damages associated with any User-Generated Content, nor are we liable for any incorrect, defamatory, libelous, false, obscene, or offensive content you may encounter in connection with User-Generated Content. User-Generated Content is the sole responsibility of the user that made it available in connection with Lokko and its interactive systems.

• Your User-Generated Content may be viewed, reproduced, published and/or modified by Lokko and such authorised third parties. The Company may delete any User-Generated Content from the Game and/or its servers at any time, for any reason, in its sole discretion without notice or liability to you. The Company reserves the right to not post or publish User-Generated Content and is not obligated to store any User-Generated Content.

• User-Generated Content that you make available through the Game must comply with the Community Standards (see Section G).

​

• Lokko may include tools that allow you to share your User-Generated Content directly to third party platforms and services (each, an “Authorized Platform"). You agree to only use and share User-Generated Content pursuant to the functionality provided by Lokko or any functionality inherent in any Authorized Platform, or as otherwise authorized by the Company, and You agree that You will not use or share (nor sub-license or otherwise permit any third party to use or share) your User-Generated Content for any other purpose. You further agree that, except to the extent authorized by the Company, You will not (and will not permit any third party to) create or use any User-Generated Content for any commercial purpose, including to receive payment or other consideration in exchange for access to such User-Generated Content, whether pursuant to or within the functionality of any Authorized Platform or otherwise.

COMMUNITY STANDARDS

• Lokko’s mission is to connect a billion people with optimism and civility. Every day, tens of millions of people around the world have fun with friends as they explore millions of immersive digital experiences. All of these experiences are built by the Lokko community, made up of millions of creators. We believe in building a safe, civil, and diverse community—one that inspires and fosters creativity and positive relationships between people around the world.

• We’ve created these Community Standards to help ensure that everyone feels safe and welcome in our shared adventure. These Community Standards apply to all of your actions on Lokko and with other Lokkoians, both online and at real-world events hosted by Lokko. 

​

• We ask that you respect our Community Standards and each other at all times — and understand that violating them may result in enforcement action against your account(s) and content. For some behavior that violates these Community Standards, such as behavior that poses a real-world risk to others, we reserve the right to contact or cooperate with the relevant authorities in order to keep everyone safe.

​

• We’re always learning, so as our community evolves and our platform grows, these Community Standards may change too. When they do, we’ll let you know here. If you see something that you think violates the Community Standards, or otherwise makes you feel unsafe, please let us know by using the Report Abuse feature. 

​

• We appreciate your cooperation with these Community Standards and commitment to keeping Lokko safe and civil.
   

SAFETY

We want our community to be a place where people can connect with optimism and civility, regardless of their identity or beliefs. To ensure Lokko is a place where everyone feels comfortable being themselves, the following is not allowed:

 

Child Exploitation

Lokko has a zero-tolerance policy for the exploitation of minors, including:

• Any predatory behavior, including attempting to befriend a minor in order to manipulate and exploit them (i.e., grooming);

• Sexualizing minors in any way;

• Engaging in sexual conversation with or soliciting sexual material from minors Sharing, requesting, or discussing child sexual exploitation material;

• Sexual extortion of children Child sex trafficking;

• Coercion and enticement of a minor to engage in illegal sexual activity

​

Terrorism and Violent Extremism

Lokko has a zero-tolerance policy for content or behavior that incites, condones, supports, glorifies, or promotes any terrorist or extremist organization or individual (foreign or domestic), and their ideology, or actions, including:

• Depictions of or support for terrorist or extremist attacks;

• Depictions of or support for the leaders or representatives of terrorist or extremist organizations Sharing the slogans, images, flags, manifestos, or icons of terrorist or extremist organizations, either in whole or in readily identifiable part;

• References to the ideologies, messages, or strategies of terrorist and extremist organizations Expressing support, condoning, or glorifying terrorist extremist ideologies or actions Recruiting membership for a terrorist or extremist organization, or encouraging others to leave Lokko to find such information; and

• Fundraising for terrorist or extremist organizations, people, or supporting groups Expressing support, condoning, or glorifying mass shootings and other acts of domestic terrorism or violent extremism.

 

Threats, Bullying, and Harassment

Threatening others with real-world or online harm, inciting violence against people or property, bullying, stalking, trolling, harassment, intimidation, extortion, and blackmail are not permitted on Lokko. We also do not allow any content that depicts, glorifies, or promotes such behavior, including:

• Threatening physical or sexual assault or violence; 

• Threatening to harm someone in real life;

• Revealing or threatening to reveal others’ personal information;

• Threatening to take over another’s Lokko account or to file false abuse reports against another user;

• Singling out a user or group for ridicule or abuse, either publicly or privately; 

• Sexual harassment; and

• Impersonating individuals, groups, or entities, in ways that may damage their reputation or cause others to harm them, either online or in real life.

Suicide, Self Injury, and Harmful Behavior

At Lokko, we take our users’ well-being very seriously. We’re here to help provide resources for those struggling with mental health, and we reserve the right to communicate with authorities regarding credible threats of self-harm. We do not allow content or behavior that depicts, glorifies, or encourages suicide, self-injury, or real-world activities that may create an extreme risk of physical harm including:

• Describing methods for suicide or self-harm;

• Content that glorifies, supports, or depicts instances or methods of suicide or self-harm; and D

• angerous physical challenges or stunts in the real world.

Discrimination, Slurs, and Hate Speech

Lokko honors and welcomes users of all ages, backgrounds, and identities. We do not allow content or behavior that supports, glorifies, or promotes hate groups, their ideologies, or actions. You also may not discriminate, mock, or promote hatred against individuals or groups, or encourage others to do so directly or indirectly, on the basis of their:

• Age

• Race, perceived race, or ethnicity 

• National origin

• Sexual orientation

• Gender, gender identity, or gender expression Religion or religious affiliation or beliefs

• Disability status including diseases, bodily conditions, disfigurement, mobility issues, and mental impairment

• Veteran status 

• Caste

• Familial status

Harmful Off-Platform Speech or Behavior

Lokkoians treat everyone with respect, both on and off of Lokko. If credibly reported to us, we may take action against users who, among other things:

• Are associated with organized crime, terrorist or extremist organizations, or hate groups Harass, bully, discriminate, or harm others outside of Lokko

• Share others’ personal information off-platform, including making false reports to authorities Have been convicted of certain egregious crimes, engage in certain illegal activities, or encourage others to do so

Civility

Civility is at the core of the Lokko community. To promote our civil environment, Lokko prohibits certain types of content, including:

 

• Real-World Sensitive Events

  • Lokko prohibits content that recreates specific real-world sensitive events; mocks the victims of such events; supports, glorifies, or promotes the perpetrators or outcome of such events; or capitalizes on these events for commercial purposes, including content about:

    • Acts of mass violence against people or property

    • Specific, real-world natural disaster events and catastrophic accidents Human or civil rights violations

    • Sensational crimes and their perpetrators

    • Inflammatory content related to real-world border, territorial, or jurisdictional relationships

• Violent Content and Gore

  • ​Although some experiences on Lokko may include weapons and violence, we do not allow content that contains extreme violence or serious physical or psychological abuse, including: Animal abuse and torture

  • Realistic or real-world depictions of extreme gore, graphic violence, or death

​

• ​Romantic and Sexual Content

  • ​​Lokko is a safe space for collaborating on creative projects, but we prohibit content that depicts sexual activity or seeks real world romantic relationships, including:

    • Romantic or flirtatious gestures or communication between users in a romantic context Pursuing or soliciting romantic relationships online

    • Engaging in unwanted flirtatious behavior

    • Engaging in sexually explicit conversations or soliciting sexual material from other Lokkoians Content that depicts, strongly suggests, or explicitly describes sexual acts

    • Nudity

    • Sexually suggestive assets or bundles

​

• Illegal and Regulated Goods and Activities​

  • We do not allow users to discuss or engage in real world illegal activities or encourage others to do so on or off Lokko. We also prohibit the discussion, depiction, or promotion of some illegal and regulated goods or activities. This includes

    • ​Controlled substances such as pharmaceutical products and recreational drugs, as well as alcohol, tobacco, vaping, and their associated paraphernalia

    • Dietary supplements and enhancers such as weight loss pills and steroids Depictions of intoxicated behavior associated with consuming alcohol or drugs Purveyors of illegal and regulated substances

    • Bomb/explosive and weapon-making instructions or schematics in the real world Realistic modern firearms outside of in-experience items

    • On-platform contests, games of chance, or competitions where Lokko or anything else of value is offered as a prize

​

Sweepstakes-style games

• ​Except where prohibited by local law or regulation, we allow unplayable gambling content, such as references to gambling and related imagery. However, we prohibit both simulated and actual gambling activities on the platform. No real money, or in-experience items of value may be exchanged in connection with any gambling activities.

 

Profanity

• To keep Lokko safe and civil for everyone, we do not allow swearing in any language text, images, or uploaded audio, including using misspellings, special characters, or other methods to evade detection of profanity Quoting or using audio containing profane lyrics.

Political Figures and Entities

We value friendly debate about social and political issues and topics that matter to the Lokko community. To maintain Lokko’s civil environment, we prohibit the discussion or depiction of content pertaining to political figures and entities, including:

​

• ​Political figures in their official capacity, including:

  • Current or recent real-world government officials

  • Candidates who are currently running for or recently ran for public office and their slogans, campaign material, rallies, or events

  • Political entities, including:

  • Political parties, including official party-affiliated organizations Specific races for elected office

  • Desecration of political symbols, such as flag burning

Note: Fundraising for political figures and entities as defined above is prohibited. Advertising for political figures and entities as defined above is prohibited by our Advertising Standards.

 

• Integrity

  • We want Lokkoians to trust each other to play fairly and honestly, and to respect one another’s creativity and hard work. To encourage this, Lokko requires its users to follow their local laws and prohibits or limits:

 

• Cheating and Scams

  • We do not permit users to deploy or discuss deceptive schemes or methods of cheating on our platform, including:

    • Using exploits to gain an unfair advantage anywhere on the platform Sharing exploits with others or encouraging others to cheat

    • Selling items with misleading or inaccurate descriptions

    • Misrepresenting your real or virtual world identity in an effort to mislead others Attempting to access another user’s account without their authorization

    • Posting misleading links for the purpose of gaining unauthorized access to others’ accounts or information, either on Lokko or elsewhere (i.e., phishing)

• Spam

  • ​Lokko prohibits disrupting or misleading others on the platform. This includes:

    • Deceptive, sensational, or otherwise misleading content or metadata used to inappropriately drive discoverability or engagement

    • Repetitive messaging to other users or uploads to Lokko systems Creating experiences solely to direct users off Lokko

​

• Intellectual Property Violations

  • We expect you to respect the intellectual property rights of others, and will remove infringing content upon receiving a valid copyright or trademark takedown request from a rights holder. Examples of intellectual property infringement may include:

    • Using another developer’s code to create your experience without their permission Using another artist’s media in your experience without their permission

    • Using a brand’s logo or designs for the content you create without their permission Copyright and registered trademark takedown requests can be filed here.

    • Lokko may proactively delete or archive assets if we suspect that the content may be infringing on someone’s intellectual property rights.

• Prohibited Advertising Practices and Content

  • All advertisements on Lokko must adhere to Lokko’s Advertising Standards. Creator guidance for complying with the Advertising Standards can be found here.

 

• Security

  • For our community to thrive, everyone must feel digitally safe as well as physically safe. We can achieve this by respecting each other’s personal information and Lokko’s safety systems, and by keeping Lokko accounts secure. This section describes how players and creators should treat others’ information and protect their own and others’ digital security.

• Sharing Personal Information

  • To maintain privacy and safety, users may be prohibited from sharing or requesting personal information on Lokko depending on their age, including:

    • Email address

    • Passwords or access tokens

    • Home address or physical location

    • Financial information including credit cards and bank account details 

    • Medical information

    • Telephone number

    • Internet Identifiers such as usernames and handles not linked to Lokko Sensitive credentials such as social security number

    • Visual and audio media of themselves or other non-public figures Sharing any links, QR codes, or barcodes

    • Efforts to evade detection of links, including but not limited to: partial links, filter-bypassing, or masked links that misdirect users

• Misusing Lokko Systems

  • Lokko maintains many systems to keep our users safe and secure, and we prohibit attempts to bypass these systems, gain unauthorized access to Lokko or to others’ Lokko accounts or information, or to otherwise violate our platform security requirements, including by:

 

• Evading Safety and Security Systems

  • Attempting to get prohibited content around our safety systems, including by hiding violative elements or assets.

  • Creating or using an account to avoid enforcement action taken against another account. Using VPNs to mask your location in order to gain unauthorized access to Lokko, including to a specific feature or account.\

  • Offering access to your Lokko account or soliciting access to another’s Lokko account for the purpose of evading enforcement action or safety systems.

 

• Disruptive Content and Behavior

  • Using bots that are programmed to run disruptive tasks.

  • Uploading content that contains obfuscated code or hidden scripts that mislead end users or create disruptive experiences for them.

  • Injecting background noise into underlying audio that makes the intended audio unintelligible. Injecting excessive loudness, screaming, or harsh noises that disrupts others’ experience, either in uploaded audio or through chat with voice.

  • Falsely reporting other users or experiences or encouraging others to do so. Invading or flooding experiences or groups in an effort to disrupt the experience or its reputation.

 

NO WARRANTIES​

• You accept the software "as is," and the Company makes no warranty as to its use, performance, or otherwise. To the maximum extent permitted by applicable law, the Company disclaims all other representations, warranties, and conditions, express, implied, statutory, or otherwise, including, but not limited to, implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. The entire risk arising out of use or performance of the software product remains with you.

 

LIMITATION OF LIABILITY

• This limitation of liability is to the maximum extent permitted by applicable law. In no event shall the Company be liable for any costs of substitute products or services, or for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, or loss of business information) arising out of this BETA EULA or the use of or inability to use the Game or the failure to provide support services, even if the Company has been advised of the possibility of such damages. In any case, the Company entire liability arising out of this BETA EULA shall be limited to the amount paid by You for the Game that caused such damage.

OPEN – SOURCE AND THIRD - PARTY SOFTWARE

• The Game may include and/or use open-source software (“OSS”) and Third-Party Software (“TPS”). You agree to be bound by those license terms in respect of the OSS and TPS contained in the Game.

INDEMNIFICATION

• You agree to defend, indemnify and hold harmless the Company and its affiliates, licensors, employees, contractors, officers, directors, vendors, and content providers from all liabilities, claims and expenses, including attorneys’ fees that arise from a breach of this BETA EULA, or any other terms, for which you are responsible. Without limiting the generality of the foregoing, you agree to indemnify and hold the Company harmless for any improper or illegal use of the Game.​

• You are solely responsible for any damage caused to the Company, its licensors, providers and contractors, other users of the Game or any other individual or legal entity as a result of your violation of this BETA EULA.

• The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification to the Company in that matter.

TERMINATION

• This BETA EULA is effective from the earlier of the date of purchase, download or use of the Game, until terminated according to its terms. Both you and the Company may terminate this EULA at any time for any reason or for no reason. Termination by the Company will be effective upon notice to you, termination or deletion of your account (if any), or the Company's decision to permanently discontinue offering and/or supporting the Game, which it may do at any time in its sole discretion. You may terminate this Beta EULA (and consequently, your account (if any)) at any time by notifying the Company at support@appymonkeys.com. Upon termination of this Agreement, your right to use the Game shall immediately cease you must immediately uninstall the Game and destroy all copies of the Game in your possession.

GOVERNING LAW AND JURISDICTION

• The terms of this BETA EULA shall be construed in accordance with the laws of England and Wales  and the courts of London, United Kingdom shall have sole and exclusive jurisdiction over any such disputes.
